This Special Notice of Intent (NOI) is not a request for competitive proposals.� This is not a solicitation or request for offers. The Department of Veterans Affairs (VA), Northern Arizona Healthcare System, intends to award a delivery order to BMK Ventures, Inc. for delivery and installation of portable air conditioning units and windows. The unusual circumstances leading to justification for other than full and open competition is underperforming HVAC systems, which have struggled to maintain comfortable indoor temperatures during periods of higher heat. As a result, supplemental cooling solutions are required to ensure occupant safety and operational continuity. BMK Ventures, Inc. is a certified Service-Disabled Veteran-Owned business (SDVOSB) listed in the Small Business Administration (SBA) certification database found eligible and capable to meet the Governments requirements expeditiously due to urgency and unusual circumstances. The anticipated statutory authority permitting other than full and open competition is in accordance with (IAW) the Department of Veterans Affair Acquisition Regulation (VAAR) 819.7008 Sole source award to a certified SDVOSB. Contracting Officers may use the non-competitive procedures authorized in VAAR 819.7008 (DEVIATION). The North American Industry Classification System (NAICS) code for this requirement is 333415. The Product Service Code (PSC) is 4130. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. Information received will be considered solely for the purpose of determining whether to conduct competitive procurement. � A decision by the Government not to conduct competitive procurement for the proposed order based upon response to this notice is solely within the discretion of the Government.
